Terms of service

These terms govern your use of patrickbourkemenswear.ie and any order you place through it. Please read them before ordering — by placing an order you agree to them.

Nothing in these terms affects your legal rights as a consumer. If any part of these terms conflicts with your statutory rights, your statutory rights win.

1. Who we are

Where these terms say "we", "us" or "our", they mean the company above. "You" means the person placing the order.

2. Who these terms apply to

These terms are written for consumers — people buying for personal use rather than for a business. If you are buying in the course of a business, the consumer protections described here do not apply to you, and our liability to you is limited as set out in section 17.

You must be at least 18 years old to place an order.

3. Your order and when a contract is formed

Placing an order is an offer to buy, not a completed contract. Here is the sequence:

  1. You place your order and we send an order acknowledgement email. This confirms we've received your order. It is not acceptance.
  2. We check stock and process your order.
  3. When we send your dispatch confirmation email — or, for click and collect, your ready for collection notification — the contract between us is formed, and only for the items named in it.

If we can't fulfil an item, we'll contact you to discuss an alternative. If no alternative suits, we'll refund that item in full.

We may decline an order where the item is out of stock, where we've identified a pricing or description error, where we can't get payment authorisation, where the order appears to be for resale, or where we can't deliver to your address.

4. Prices

All prices include Irish VAT where applicable and are shown in the currency you have selected. Delivery charges are shown separately at checkout before you pay.

Currency. Our base currency is euro. If you pay in another currency, the amount is converted at the rate in effect at the time of purchase, and your bank or card issuer may apply its own charges.

Price reductions. Where we advertise a reduction, the "was" price we show is the lowest price we charged for that item in the 30 days before the reduction began, in line with Irish price-display rules.

Pricing errors. Occasionally an item may be mispriced. If the correct price is higher than the price shown, we'll contact you before dispatch to ask whether you want to proceed at the correct price or cancel. We won't simply charge you the higher amount. If the error is obvious and could reasonably have been recognised as a mistake, we're not obliged to supply at the incorrect price.

5. Payment

We accept the payment methods shown at checkout, currently including Visa, Mastercard and PayPal. Payment is taken when your order is placed. Your card details are handled by our payment providers and are not stored by us.

6. Delivery

Delivery charges, destinations and estimated timescales are set out on our Delivery Information page, which forms part of these terms.

Delivery timescales are estimates, not guarantees. If delivery is significantly delayed, contact us and we'll sort it out. If we fail to deliver within 30 days of the contract, or within any longer period we've agreed with you, you may cancel and receive a full refund.

Risk and ownership. Goods are at your risk from the moment they're delivered to you or to someone you've nominated at the delivery address. Ownership passes to you once we've received payment in full.

Click and collect. Please wait for your ready for collection notification before travelling — stock may be held at another of our stores. Bring your order confirmation and photo ID.

Deliveries outside Ireland. For destinations outside the EU customs union, including Great Britain and Norway, prices exclude local import VAT and duty. These are payable by you on arrival and are set by the destination country, not by us. Some brands restrict where their products may be shipped; any such restrictions are noted on our Delivery Information page.

7. Your right to cancel — 14-day cooling-off period

If you are a consumer in the EU, Ireland, Norway or the UK, you have a legal right to cancel your order without giving any reason.

The period. 14 days from the day you, or someone you nominate, receives the goods. If your order arrives in several parts, the 14 days runs from the day you receive the last item.

How to cancel. Tell us clearly before the 14 days is up — email info@patrickbourkemenswear.ie, phone +353 (0)65 68 44330, or write to us. You may use the model cancellation form in section 8, but you don't have to; any clear statement will do.

Returning the goods. Send them back within 14 days of telling us you're cancelling. You pay the return postage. Our Returns and Exchange page explains the options.

Your refund. We'll refund the price of the goods, using the same payment method you used. If you chose a more expensive delivery option than our standard one, we refund the standard rate. We'll issue the refund within 14 days of receiving the goods back, or of you proving you've sent them, whichever is sooner.

Handling the goods. You may examine goods as you would in a shop. If you handle them beyond that and their value drops as a result, we may reduce your refund accordingly.

This right applies to sale and discounted items in exactly the same way as to full-price items.

The limited exceptions. The cancellation right does not apply to goods made or personalised to your specification, or to sealed goods that aren't suitable for return for health or hygiene reasons where the seal has been broken after delivery — for us, that means underwear and swimwear where the hygiene seal has been removed. If the seal is intact, you can still cancel.

9. Our own returns policy

Separately from your legal cancellation right, we offer a 28-day returns window for change of mind, on the conditions set out on our Returns and Exchange page — goods unworn, unused, tags attached, in original packaging for all online purchases. Instore purchases have a different policy. 

10. If something is faulty or not as described

Under the Consumer Rights Act 2022, goods we supply must be of satisfactory quality, fit for purpose, and match their description.

  • Within 30 days of delivery, if goods are faulty you can reject them and get a full refund.
  • After 30 days, you're entitled to a free repair or replacement. If that isn't possible, would take an unreasonable time, or fails, you can ask for a price reduction or a refund.
  • For the first 12 months, if a fault appears we take it that the fault was there at delivery, unless we can show otherwise.
  • You can bring a claim for up to 6 years from purchase.

None of this is affected by our 28-day change-of-mind policy, or by the goods being on sale. If something's wrong, email info@patrickbourkemenswear.ie with your order number and a photo, and we'll deal with it. You won't be charged for returning faulty goods.

11. Product safety

We take product safety seriously. Safety information and the details of the manufacturer or EU responsible person are provided with the product or on the product page, as required by the EU General Product Safety Regulation.

12. Product descriptions, images and sizing

We take care to describe and photograph products accurately, but screens vary and colours may appear differently on your device. Sizing guidance and fit tools on the site are indicative — they're a guide, not a promise of fit. Packaging may differ from images shown.

13. Gift cards

Gift cards bought from us are valid for life from the date of issue. You don't have to spend the full value in one transaction — any remaining balance stays on the card.

Gift cards can't be exchanged for cash. Gift cards purchased online or in store are redeemable in our stores only, not on this website. We can't replace gift cards that are lost or stolen after delivery, so please keep them safe.

14. Your account

If you create an account, keep your password confidential and don't let anyone else use it. Tell us promptly if you think someone else has access. We may suspend or close an account we reasonably believe is being used fraudulently or in breach of these terms.

15. Reviews, and anything you post

If you leave a review or post content on our site, you must own it or have the right to use it, and it must not be false, offensive, defamatory or unlawful.

We publish reviews as we receive them and take reasonable steps to check they come from genuine customers. We don't publish fake reviews, we don't pay anyone to leave a positive review and present it as independent, and we don't delete negative reviews just for being negative. We may remove content that breaks the rules above.

By posting content, you allow us to use it in connection with our business. We won't pay you for it.

16. Using this website

Please don't use the site to break the law, infringe anyone's rights, upload malicious code, scrape or harvest data, or interfere with how the site works. We may suspend access if you do.

The content of this site — text, images, logos, design — belongs to us or our licensors and is protected by copyright and trade mark law. You may view and print pages for your own personal use. Anything else needs our written permission.

Our site may link to other websites. We don't control them and aren't responsible for their content.

17. Our liability

We're responsible for loss you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. Loss is foreseeable if it's obvious it will happen, or if we both knew it might when the contract was made.

We do not limit or exclude our liability in any way for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; your rights in relation to faulty or misdescribed goods; or anything else that can't be limited or excluded under Irish law.

We're not responsible for business losses. If you use products for any commercial purpose, we have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.

18. Events outside our control

We're not liable for failure or delay caused by something outside our reasonable control — including strikes, courier failure, extreme weather, fire, flood, power or network failure, or government action. If such an event happens, we'll contact you and either agree a new timescale or cancel and refund you in full.

19. Complaints and disputes

If we can't resolve it between us:

  • Competition and Consumer Protection Commission (CCPC) — the Irish consumer protection body. ccpc.ie, helpline 01 402 5555.
  • European Consumer Centre Ireland — free advice for cross-border purchases within the EU, Norway and Iceland. eccireland.ie.

Please note that the European Commission's Online Dispute Resolution platform closed on 20 July 2025 and is no longer available.

20. Governing law

These terms are governed by the law of Ireland, and the Irish courts have jurisdiction.

If you are a consumer resident in another country, this does not deprive you of the protection of any mandatory consumer laws of the country you live in, and you may also bring proceedings in the courts of that country.

21. Changes to these terms

We may update these terms. The version that applies to your order is the version published when you placed it, so the date at the top matters. Changes don't apply retrospectively to orders already placed.

22. General

If any part of these terms is found to be unenforceable, the rest continues to apply. If we don't insist on something straight away, we can still insist on it later. These terms are between you and us — nobody else can enforce them.
